The Rise Cup terms and conditions

  1. Introduction: Spark New Zealand (“Spark”) is running an esports Tournament called The Rise Cup (the “Tournament”) in collaboration with Epic Games, Inc (“Epic”) and Letsplay.live (“LPL”) on the popular free-to-play battle royale video game, Fortnite. This is a free entry tournament restricted to entrants above the age of thirteen years old.  By registering for the Tournament, you agree to these terms and conditions.
  2. Who can enter: This Tournament is open to Spark customers and non-Spark customers who are New Zealand residents 13 years and above and is not open to employees of Spark, its agents, contractors, consultants, or their families (including de facto spouses) or to other persons assisting with this Tournament. The Tournament is only open for personal non-commercial use. Players banned by Epic Games & LPL are not allowed to participate and this will be strictly enforced.
  3. Dates: The Tournament will open for registration on Monday 2 October 2023. Registrations will close at 11pm Monday 23 October 2023. The Tournament will commence at 9am on Saturday 28 October 2023 and conclude on Sunday 12 November 2023. Gameplay timings will be managed in Discord. Entrants must fill in all of the fields in the registration entry form and sign into the Spark Game Arena Discord server to enter. All valid registrations must be received by 11pm on Monday 23 October 2023 and will be eligible to play and win prizes.
  4. Limits on entries and player rules: There is only one entry per Tournament. Players may not compete on behalf of another player or person (also known as ‘smurfing’). Breaking this rule will result in all matches being overturned where the breaches occurred. After consecutive overturns, harsher penalties may apply. Players are not allowed substitutes.
  5. Requirements to play: In order to participate in the Tournament, you must have:
    1. An Epic Games account for PC and Mac players, an Xbox account for Xbox players, a PSN account for PlayStation players, a Nintendo account for Nintendo players or an eligible account for mobile devices (Android, iPadOS, iOS).
    2. Installed Fortnite on your gaming machine of choice for use in the tournament (PC/Mac/Xbox/Switch/Nintendo) and signed into Fortnite with the relevant account as detailed above;
    3. A Discord account.
  6. Applicable terms: Your participation in the Tournament must be in accordance with these Terms and Conditions, Discord’s terms and conditions, Fortnite’s official rules and terms, Spark Game Arena’s rules for its Discord server, and our Community Guidelines.
  7. Discord: Spark & LPL have chosen to use the voice/chat online social media platform known as Discord during its running of the Tournament. This will be within the official Spark Game Arena Discord server. It is a prerequisite for participating in the Tournament for all players to use Discord before and during the matches to receive information relating to the tournament, as well as to report any issues being experienced in-game or within the Discord Server. LPL will be monitoring the Discord server, and players will be able to seek live support from the Admin account via the Ticket Bot with any queries, comments or concerns at any time following verification. Players are verified within the Discord against the prerequisite of properly completing the Registration form on the spark.co.nz/therisecup page. Your ability to participate in the Tournament (including using Discord) is strictly subject to your compliance with the Tournament Community Guidelines. While the Community Guidelines describe certain actions Spark may take against you for failure to comply with the Community Guidelines, those descriptions are not exclusive or exhaustive and are intended primarily for informational purposes. Any failure to abide by the Community Guidelines constitutes a violation of these Terms.
  8. How do I play and win: On Saturday 28 at 9am, entrants are required to check in to the Spark Game Arena Discord server. Entrants will be divided up into lobbies within Discord by LPL, following the closure of registrations. Within these lobbies, LPL will communicate the time of the rounds to be played, as well as the lobby code within Fortnite for the specific round, which players use to begin gameplay. Gameplay will be Solos with ‘Build mode off’ also known as Zero-Build in Solo mode. You must have your Fortnite username visible to participate. The winners from each lobby will be the result of an aggregated score from each round. LPL will then communicate the scores within the Discord lobby for entrants to see. Once the scores are posted, LPL will move those who successfully qualified into the next lobby. The first round will be the best of 1 game where positional placement determines who progresses, the second round will consist of 3 games to points to progress, and the final round will consist of 5 games to earn points to determine the winner.
  9. Changing usernames: If you change your Discord username or Fortnite display name after registering for the tournament (or you registered using the incorrect usernames) you must comply with the following or you will not be able to participate:
    1. It is your responsibility to check the correct usernames within Fortnite and Discord before inputting them in the registration fields.
    2. If you identify that you have provided incorrect username information, or you want to change your username, you must contact sgahelp@spark.co.nz no later than 24 hours before the next commencement time of gameplay. For any requests to change information within 24 hours of a match, Spark cannot guarantee this will be amended in time for the gameplay and therefore you may not be able to participate. In the event of this occurring before a singular qualifying match, you will be disqualified. If this occurs before any matches beyond the qualifying matches, you may be able to participate in subsequent matches if you miss one. 
  10. Finals tie-breaker system: Tiebreakers for any session’s Leaderboard or Match Point will be determined in the order presented here: (1) total points scored; (2) total Victory Royales in the session; (3) average eliminations in the session; (4) average placement per match in the session; and finally (5) total seconds survived across all matches
  11. Points system: For elimination rounds, no points will be given, and results will solely be determined on positional placement at the end of a round. For rounds where there are multiple games being played before winners are determined, points are allocated based on positional placement and the number of eliminations per player. Letsplay.live will designate points to players at the end of each round of gameplay based on the below structure. Points system; Each Elimination: 4 Points; 1st place (Victory Royale): 65 Points; 2nd: 56 Points; 3rd: 52 Points; 4th: 48 Points; 5th: 44 Points; 6th: 40 Points; 7th: 38 Points; 8th: 36 Points; 9th: 34 Points; 10th: 32 Points; 11th: 30 Points; 12th: 28 Points; 13th: 26 Points; 14th: 24 Points; 15th: 22 Points; 16th: 20 Points; 17th: 18 Points; 18th: 16 Points; 19th: 14 Points; 20th: 12 Points; 21st: 10 Points; 22nd: 8 Points; 23rd: 6 Points; 24th: 4 Points; 25th: 2 Points
  12. Player Connectivity: It is your responsibility to have a stable high-speed low-latency Internet connection and adequate hardware that meets any Fortnite technical requirements, and ensure your Fortnite and Epic games platform is up-to-date and fully patched. Should an issue arise regarding widespread connectivity problems to the server, then we may cancel or postpone the match and notify affected players via Discord. Spark Game Arena administrators may eject any player from a server or overturn a match result if their connection has a serious impact on the game, it is your sole responsibility to make sure your connection is acceptable to the server. Congestion or individual connectivity issues are not an acceptable reason for warping or lagging. Players may raise a Ticket using the Ticket Bot for live support from Admin. There is no guarantee that Admins will be able to resolve your issue; some issues are caused by household connectivity issues for example and these cannot be resolved by the Admins.
  13. Match Pausing: There is no match pausing allowed in the Tournament.
  14. Models / Skins: All cosmetic skins and emotes are allowed for competitive play.
  15. Graphical Settings: If a player is found using any 3rd party applications or mods that alter the appearance of in-game graphics or objects in any way, it will result in the appropriate consequences from the LPL or Spark Game Arena administration team.
  16. Outside Applications: Using outside applications to manipulate, change or alter the Fortnite gaming environment is prohibited. This will result in the immediate suspension/ban of a player and/or team and will be considered a cheating violation. Users caught running 3rd party applications that alter the gaming environment will be subjected to Spark’s Community Guidelines. This will most likely lead to an extended or sometimes permanent ban from all Spark Game Arena events.
  17. Map Exploits: The use of any exploits or map glitches is strictly forbidden. The use of such exploits will lead to the appropriate consequences from the LPL or Spark Game Arena administration panel.
  18. Cheats / Hacking: Cheats and hacking are not permitted. This includes cheating via unauthorised manipulation of: server configurations and server variables, client configurations and client variables, models, skins, entities, textures, weapon, sounds, or as otherwise described in these terms. Hacking includes but is not limited to: wall hacks, aim bots / auto aimers, speed hacks, ESP, or any other third-party program which alters the game in a way that the game developer did not intend for. Users caught cheating/hacking will be subjected to our Community Guidelines. This will most likely lead to an extended or sometimes permanent ban from all Spark Game Arena events and an inability to win any prizes in this Tournament or others.
  19. Player dropouts: In the event that a player’s Fortnite game times out/crashes, the game will proceed without them. If in the event more than half of the registered players in the lobby do not connect then an administrator may reset the lobby and match for a later time.
  20. Late entry: Spark is not responsible or liable for any late entries to the Tournament (or any lobby) caused by you (provided you have taken all necessary steps to enter the promotion), which may result in delay or failure to enter you the Tournament. Players added after a match start time or when rosters are locked will become ineligible and will not be able to participate in the match(es).
  21. Privacy: Any personal information collected as part of this Tournament will be held by Spark in accordance with its privacy policy. You have the right to access, update and correct such information.
  22. Streaming of Tournament on YouTube and Twitch: Spark and LPL will be livestreaming the finals of the Tournament on the global video hosting platforms YouTube and Twitch, alongside voice-over commentary. Participants agree to Spark and LPL’s streaming of the Tournament (including footage of their avatar and their Fortnite Display Name), and the use of this footage for potential future promotional material. The livestream will be available after the stream finishes on the Spark Game Arena YouTube Channel. Spark and LPL reserve the right to remove footage, information or entities at our discretion at any point without notice. Spark reserves the right to pass information to New Zealand legal jurisdictions in the event of serious online harm. This livestream will not include camera footage of players themselves.
  23. Use of Winners’ details and gameplay footage: Accepting a prize constitutes the winner's consent to Spark to using their name, city/town of residence, Fortnite name, Fortnite avatar, game footage and/or still images from the game for publicity purposes (including on advertising) without further compensation.
  24. Intellectual Property: You must not act in any way that infringes any of Spark's or another third party's intellectual property rights, including, for example, unauthorised downloading, modification or broadcasting of content from the Tournament. You also must not imply an association, endorsement or sponsorship between yourself, Spark, LPL or Epic unless authorised by us to do so.
  25. Participant obligations: You must not act in a way, or use or introduce anything (including any virus, worm, trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Tournament or the platforms used within it, or otherwise attempt to damage or interfere with the Tournament.
  26. Prohibition on bribery, gambling, money laundering, etc.: If you participate in a Tournament, you must not:
    1. accept a bribe or agree to fix a game or Tournament;
    2. fail to report a bribe offer or an attempt to fix a game or Tournament;
    3. engage in activity that constitutes a money laundering offence under the Anti-Money Laundering and Countering Financing of Terrorism Act;
    4. bet or gamble on a Tournament;
    5. knowingly associate with gamblers or gambling activity in relation to a Tournament
  27. Decisions: You agree that our decisions are final and binding on you in all respects. Spark or LPL, at their sole discretion, may disqualify any entrant from a tournament, refuse to award benefits or prizes and require the return of any prizes, overturn any match results or take other action as we see fit. Such action may be taken when there is a breach of these terms or our community guidelines, or an entrant engages in conduct or otherwise utilises any information Spark deems to be improper, unfair or otherwise adverse to the operation of the tournament, or acts in any way detrimental to other entrants. Administrators reserve the right to add or update any rule as necessary to keep matches fair. Administrators have the final say in any and all decisions.   28. Prizes: There is a total prize pool of $30,011.0500 in value. This is made up of cash and items. Prizes cannot be transferred or exchanged or redeemed for cash. Spark takes no responsibility for entries or prizes that are lost or destroyed. Spark accepts no responsibility or liability for any prize winner’s enjoyment of any prize or any other costs and expenses that may be incurred by the prize winner relating to the prize or the winner’s enjoyment of that prize.

  30. Notification of winners: Winners will be notified either in person or by phone and/or email between Tuesday 13 November 2023 and Wednesday 29 November 2023. Spark will endeavour to notify selected winners by text, phone or email and deliver prizes by courier, but reserves the right to notify selected winners and deliver prizes by other means. Spark will make reasonable attempts to contact the winner, but if the winner is not able to be contacted or is unable to redeem the prize in accordance with the terms and conditions within three days from the first contact attempt (for example fails to provide a shipping address), the prize will be redrawn in his or her place without liability to any person.
  31. Tournament Prize & Prize Money distribution: Upon complete submission of tournament scores and required supporting documentation by the players and/or the Tournament Organiser, Spark will provide 7 days for any dispute from other players to be raised and resolved in relation to the tournament scores. Once Spark has validated the tournament completion and the winners, at its sole discretion, Spark will disburse the prize/prize monies. If you win a prize your prize money will be paid to a bank account elected by you for payment of the prize money. This process will be completed and prize money will be processed within 5 business days of the Tournament’s conclusion. You’re responsible for any tax payable on prize monies.
  32. General: To the extent permitted by law, Spark excludes any liability it may have to you arising directly or indirectly out of or in connection with this Tournament. To the extent our liability cannot be excluded under law, our liability to you is limited to the value of the highest prize in the Tournament. To the extent permitted by law, any claim raised by you in connection with the Tournament or our breach of these Terms must be raised within 60 days after the end of the Tournament or the date on which the breach or event giving rise to the claim occurred (whichever is earlier). New Zealand courts will have exclusive jurisdiction over any dispute arising under these Terms. The decisions of Spark on all matters relating to this Tournament are final and no correspondence will be entered into. Spark reserves the right to verify the validity of an entry or a winner's right to redeem the prize in accordance with these terms and conditions. Spark reserves the right to amend the prizes offered and these terms and conditions and in its absolute discretion cancel or alter the Tournament rules at any time and without prior notice.
  33. Disclaimer: THIS EVENT IS IN NO WAY SPONSORED, ENDORSED, OR ADMINISTERED BY, OR OTHERWISE ASSOCIATED WITH, EPIC GAMES, INC. THE INFORMATION PLAYERS PROVIDE IN CONNECTION WITH THIS EVENT IS BEING PROVIDED TO EVENT ORGANIZER AND NOT TO EPIC GAMES, INC. BY PARTICIPATING IN THIS EVENT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, PLAYERS AGREE TO RELEASE AND HOLD HARMLESS EPIC GAMES, INC., ITS LICENSORS, ITS AND THEIR AFFILIATES, AND ITS AND THEIR EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, CONTRACTORS, AND OTHER REPRESENTATIVES FROM ALL CLAIMS, DEMANDS, ACTIONS, LOSSES, LIABILITIES, AND EXPENSES RELATED TO THE EVENT.
